I Missed My SEND Tribunal Evidence Deadline. What Should I Do?

If you've missed a SEND Tribunal evidence deadline, you're probably feeling overwhelmed.

Many parents contact me saying:

  • "I've only just realised the deadline has passed."

  • "I didn't know I had to submit evidence by that date."

  • "My Educational Psychologist's report isn't ready."

  • "Have I ruined my appeal?"

The good news is that missing an evidence deadline does not automatically mean your appeal is over.

What happens if I miss the evidence deadline?

The SEND Tribunal sets deadlines to help keep appeals on track, but each case is different.

Missing a deadline does not mean your appeal is automatically dismissed.

However, it can make things more complicated.

The Tribunal will consider factors such as:

  • Why the evidence is late.

  • Whether the delay is reasonable.

  • Whether admitting the evidence would unfairly disadvantage the other party.

  • Whether the evidence is important to deciding the appeal fairly.

Can I still submit late evidence?

Sometimes, yes.

The Tribunal has the power to consider late evidence, particularly where it is relevant and helps determine the issues in dispute.

However, you should not assume that late evidence will automatically be accepted.

The earlier you act, the better.

What if my Educational Psychologist's report isn't ready?

This is one of the most common reasons parents miss deadlines.

Independent assessments often take longer than expected, particularly if appointments are delayed or reports require amendments.

If an important report won't be available before the deadline, you should consider your options as soon as possible rather than waiting until after the deadline has passed.

Should I tell the Tribunal?

If circumstances have changed or you know evidence will be late, it is generally better to communicate this promptly rather than ignore the deadline altogether.

Every appeal is different, and the appropriate approach will depend on the stage of proceedings and the reasons for the delay.

What should I do now?

If you've missed an evidence deadline:

  • Don't panic.

  • Work out exactly which deadline has been missed.

  • Identify what evidence is still outstanding.

  • Gather any documents that are already available.

  • Consider whether further action needs to be taken before the hearing.

The sooner you deal with the situation, the more options you are likely to have.

Will I lose my appeal?

Not necessarily.

SEND Tribunals are concerned with reaching the right decision based on the evidence available.

While missing deadlines can create difficulties, it does not automatically mean you will lose your case.

Many successful appeals involve procedural issues that are resolved before the hearing.

The important thing is understanding your position and deciding the best way forward.
